Arizona Can Require Surgery Proof for Birth Certificates

A federal appeals court Tuesday reinstated Arizona’s requirement that residents provide medical proof of sex reassignment surgery before changing the sex marker on their birth certificates, reversing a lower court that had blocked the law.

The Ninth Circuit’s two-judge panel found Arizona’s statute passes constitutional muster because it doesn’t create a suspect classification based on transgender status. Judge Roopali Desai, writing for the panel, said the law applies the same standard to everyone seeking to amend their birth certificate’s sex designation.

“The panel held that Arizona’s birth certificate amendment statute does not violate the equal protection clause,” Desai wrote in the 26-page opinion. She noted that transgender people who haven’t undergone surgery can still amend their birth certificates through a court order—the same process available to any Arizonan seeking to change birth records.

Lower Court Overstepped Constitutional Authority

The appeals court found that Senior U.S. District Judge James Soto improperly granted a permanent injunction that removed the word “operation” from Arizona’s statute. The panel reversed his summary judgment for the plaintiffs and sent the case back to district court.

The lawsuit began in 2020 when a group of Arizona transgender residents, including minors, filed a class action against the state’s health department director. They argued the surgery requirement created an unconstitutional barrier to updating official documents.

What Rational Basis Review Means

The Ninth Circuit applied “rational basis review”—the most lenient constitutional standard—because Arizona’s law doesn’t single out a protected class under equal protection doctrine. Under this standard, the state only needs to show its law has a legitimate purpose and a rational connection to achieving it.

Birth certificates serve as legal records of biological facts at birth. Arizona argued its requirement ensures accuracy in vital statistics and maintains the integrity of public records. The panel found this reasoning sufficient under rational basis review.

The ruling affects how all 15 Arizona counties process birth certificate amendments. It also signals how federal courts may handle similar state laws requiring medical verification for document changes.
