Judge Blocks Virginia ICE Mask Ban

A federal judge blocked Virginia’s law banning ICE agents from wearing masks just hours before it was set to take effect, ruling the state cannot dictate how federal officers protect themselves while enforcing immigration law.

Senior U.S. District Judge Robert Payne issued the preliminary injunction late Monday night, finding the Justice Department would likely prevail on its argument that Virginia’s mask ban violates the Constitution’s Supremacy Clause and the doctrine of intergovernmental immunity.

“There is evidence that enforcement of the mask/identity statute would expose federal employees to real risk of physical harm in, and in connection with, the discharge of their duties when enforcing federal immigration law and policy,” wrote Payne, a George H.W. Bush appointee, in his three-page order.

State Law Would Have Required Face Identification

The Virginia statute, passed earlier this year, would have prohibited U.S. Immigration and Customs Enforcement officers from concealing their faces during enforcement operations within the commonwealth. The law also included provisions requiring federal law enforcement to display visible identification.

The Justice Department argued that allowing states to regulate federal officers’ safety equipment and operational tactics would undermine federal authority and create a patchwork of conflicting requirements across the country.

Similar California Law Already Struck Down

ICE officials pointed to a previous appellate court decision blocking California’s law that required officers to wear visible identification. That precedent supported the government’s position that states lack authority to impose operational requirements on federal immigration enforcement.

Judge Payne agreed, finding the government would suffer irreparable harm “because its valid laws and practices in a domain of federal authority are undermined by impermissible state regulation.”

What Happens Next

The preliminary injunction prevents Virginia from enforcing the mask ban while the underlying lawsuit proceeds. The state can appeal Payne’s decision or continue defending the law’s constitutionality in district court.

Virginia lawmakers who supported the legislation have not yet commented on the ruling. The case tests fundamental questions about whether states can impose safety or transparency requirements on federal officers operating within their borders, even when those requirements conflict with federal operational practices.
