Texas Dad Charged in Belt-Beating Death of 9-Year-Old

A Texas father faces capital murder charges after police say he beat his 9-year-old daughter to death with a belt in February because she smirked at him. Marquise Anderson, 35, was arrested Tuesday, four months after Joanna Shoulder died from what medical examiners determined were extensive blunt force injuries.

According to an affidavit obtained by Fort Worth NBC affiliate KXAS, Anderson told investigators that spanking wasn’t enough punishment after his daughter smirked at him, so he escalated to beating her with a belt. The child died from her injuries on February 8.

What Police Found at the Fort Worth Home

First responders were called to Anderson’s Fort Worth home in February after reports of an unresponsive child. Joanna Shoulder was pronounced dead at the scene. Medical examiners documented extensive injuries consistent with prolonged physical abuse, not a single disciplinary incident.

Anderson remained free for months while detectives built their case. He was formally charged with capital murder of a person under 10 years old this week and is being held in the Tarrant County jail. Under Texas law, the charge carries a mandatory sentence of life in prison without parole, as prosecutors cannot seek the death penalty when the victim is under 10.

The Legal Standard for Capital Murder

Texas created a specific capital murder statute for victims under 10 years old in 2011, treating the killing of young children as categorically more serious than standard murder charges. The law removes any requirement to prove premeditation or motive beyond the act itself.

Defense attorneys in similar cases have tried arguing that parents didn’t intend to kill their children during discipline that went too far. Prosecutors counter that adults are responsible for understanding that beating a child with sufficient force to cause death demonstrates the requisite criminal intent, regardless of what they claim they meant to do.

Anderson’s case will likely hinge on the medical evidence documenting the extent and severity of Joanna’s injuries. If the forensic pathology shows a pattern of escalating abuse rather than a single tragic error in judgment, prosecutors will argue that distinction becomes legally irrelevant—the child is still dead by her father’s hand.

A preliminary hearing has not yet been scheduled. Anderson remains in custody without bond.
