The Department of Transportation announced Friday that it will begin requiring all Americans to submit a “Vehicle Justification Form” before purchasing cars or trucks that weigh over 3,500 pounds or achieve less than 40 miles per gallon.
The new regulation, part of the Infrastructure Equity and Climate Accountability Act, mandates that prospective buyers of SUVs, pickup trucks, and other large vehicles must demonstrate “legitimate need” for such transportation before completing their purchase.
“For too long, Americans have been making personal transportation choices without considering the broader societal impact,” said Transportation Secretary Miguel Cardona at a press conference. “This common-sense reform simply asks people to pause and reflect on whether they truly need a Ford F-150, or if a Nissan Leaf would suffice.”
Under the new system, buyers must complete a 12-page questionnaire detailing their occupation, family size, recreational activities, and frequency of hauling materials. Applications will be reviewed by regional Transportation Equity Boards, with decisions typically rendered within 45-60 business days.
Approved “legitimate needs” include farming, commercial construction, and families with four or more children. The department clarified that “wanting to feel safe on the highway” and “liking trucks” do not qualify as legitimate needs.
Applicants denied approval will receive a voucher for $3,500 toward the purchase of an electric vehicle or public transportation pass. Those who appeal the decision must attend a mandatory four-hour “Sustainable Transportation Awareness Workshop” before their case can be reconsidered.
The American Automobile Association has filed suit challenging the regulation, calling it “an unprecedented government overreach into personal consumer decisions.” The lawsuit is expected to be heard by the Ninth Circuit Court of Appeals next spring.
Implementation begins January 1, 2027, with exemptions for emergency vehicles, commercial fleet operators, and members of Congress.
